Herriot Financial, LLC (“Herriot Financial,” “we,” “us,” or “our”) is a registered investment adviser based in Alameda, California. We value the trust our clients and website visitors place in us, and we take seriously our obligation to protect the personal information you share with us. We do not sell your personal information.
This Privacy Policy describes our practices in two parts:
- Part I — Privacy Notice for Advisory Clients and Prospective Clients. This is the privacy notice we are required to provide under federal Regulation S-P (the Gramm-Leach-Bliley Act) and applicable state law. It describes how we handle “nonpublic personal information” of clients and prospective clients.
- Part II — Website Privacy Practices. This part describes how we handle information collected from visitors to our website, including readers, book buyers, calculator users, and people who join our workshop waitlist or mailing list.
This Policy applies to herriotfinancial.com and related landing pages, registration forms, and email communications (collectively, the “Sites”). It does not apply to third-party websites or services linked from the Sites, including the websites of book retailers, podcast hosts, custodians, or other affiliated tools.
PART I — PRIVACY NOTICE FOR ADVISORY CLIENTS AND PROSPECTIVE CLIENTS
Why We Collect Your Information
We gather nonpublic personal information (“NPI”) about you so that we can (A) design, implement, and administer the investment advisory services we provide; (B) communicate with you about your portfolio and financial matters; and (C) comply with the federal and state laws and regulations that govern us as a registered investment adviser.
What Information We Collect
In the course of providing investment advisory services, we may collect the following categories of NPI:
(A) Information you provide during our initial meeting, onboarding, account opening, or subsequent consultations, such as your name, address, telephone number, email address, date of birth, Social Security number, employment information, financial situation, investment objectives, risk tolerance, and other information necessary to provide advisory services;
(B) Information we generate or receive in the course of servicing your account, including account balances, holdings, transaction history, performance data, and communications between us;
(C) Information we receive from third parties in connection with the services we provide you, including from custodians, sub-advisers, other financial institutions, or professionals you have authorized to share information with us.
What Information We Disclose
We are permitted by law to disclose NPI about you to unaffiliated third parties in certain circumstances. Herriot Financial may disclose a client’s NPI:
(1) to individuals or entities not affiliated with Herriot Financial that assist in the supervision, management, or administration of your account, including but not limited to sub-advisers, the account custodian, recordkeepers, your attorney, accountant, or other authorized professionals;
(2) to service providers we engage to perform functions on our behalf, including client management systems, document storage and archiving vendors, cloud service providers, financial planning software providers, billing services, and compliance vendors;
(3) to your authorized representative, power of attorney, or other party you have directed us to share information with;
(4) when we receive your prior consent;
(5) in connection with a proposed or actual sale, merger, transfer, or reorganization of all or a portion of our business; and
(6) as otherwise permitted or required under applicable federal and state privacy regulations, including in response to subpoenas, court orders, regulatory examinations, or other lawful requests from authorities.
We do not disclose NPI for marketing purposes to unaffiliated third parties.
Opt-Out Rights
If Herriot Financial changes its privacy practices in a manner that would allow disclosure of NPI beyond what is permitted under applicable law, we will provide clients with notice and an opportunity to opt out of such disclosure before it takes effect.
How We Protect Your Information
We restrict access to NPI to those of our personnel and contractors who need it to perform their business functions. We maintain physical, electronic, and procedural safeguards designed to prevent unauthorized access, disclosure, or misuse of NPI. Service providers and independent contractors who handle client information on our behalf are subject to confidentiality obligations.
While we use commercially reasonable measures to protect information, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Former Clients
Even if we cease to provide advisory services to you, this Privacy Notice continues to apply to your NPI, and we will continue to treat it confidentially. We retain client records for the period required by applicable law and regulation.
Delivery of This Notice
Clients receive this Privacy Notice at the start of the advisory relationship and on an annual basis thereafter, as required by Regulation S-P. The most current version is available at any time on our website.
PART II — WEBSITE PRIVACY PRACTICES
This Part II describes how we handle information collected from visitors to our Sites who are not advisory clients, including readers of the book Time Freedom, users of the Time Freedom Calculator, podcast listeners, workshop waitlist signups, and general website visitors.
Information You Provide
We may collect your name and email address when you join our mailing list, sign up for the Live Investing Workshop waitlist, download the book’s bonus chapter, request to schedule a screening call, or otherwise interact with the Sites.
Information Automatically Collected
When you visit the Sites, we may automatically collect Device Information, including IP address, browser type, operating system, general location, referring URLs, pages viewed, and interactions with the Sites. This information is collected through cookies and similar technologies.
Cookies and Analytics
We and our service providers use cookies, pixels, and similar tracking technologies to enable functionality, analyze performance, and support marketing activities. We may use analytics tools such as Google Analytics to understand how visitors interact with the Sites and to improve performance. You can manage cookies through your browser settings and through any cookie consent banner presented on the Sites.
How We Use This Information
We use website visitor information to (A) operate, maintain, and improve the Sites; (B) respond to inquiries and screening call requests; (C) deliver newsletters, workshop information, and other communications you have requested; (D) administer the workshop waitlist; (E) analyze usage trends; (F) prevent fraud and protect the security of the Sites; and (G) comply with legal obligations.
Sharing of Website Visitor Information
We do not sell website visitor information. We may share it with service providers that perform services on our behalf (such as email delivery, website hosting, and analytics); to comply with legal obligations; to protect our rights, property, or safety; and in connection with a business transaction. Website visitor information is handled separately from client NPI, except when a website visitor subsequently becomes a client.
Email Communications
If you subscribe to our emails, you may opt out at any time by using the unsubscribe link included in the email. You may continue to receive non-marketing communications related to services or events you have requested.
Minors
The Sites are not directed to individuals under the age of 18. We do not knowingly collect personal information from individuals under 16. If we learn that such information has been collected, we will delete it.
YOUR PRIVACY RIGHTS
California and Certain U.S. State Rights
Depending on your state of residence, you may have rights to request access to, correction of, or deletion of your personal information; to opt out of certain data processing activities; and to be free from discrimination for exercising your rights. Certain financial information regulated under the Gramm-Leach-Bliley Act may be exempt from state privacy laws. We do not sell personal information.
European Union and International Users
If you are located outside the United States, including in the European Union, you may have additional rights under applicable data protection laws, including the right to access, correct, or delete your personal information. Your information may be transferred to and processed in the United States.
EXERCISING YOUR RIGHTS
You may submit privacy requests or questions about this Policy by emailing brian@herriotfinancial.com. We may need to verify your identity before processing your request, as permitted by law.
CHANGES TO THIS POLICY
We may update this Policy from time to time. The “Last Updated” date reflects the most recent revision. For advisory clients, material changes will be communicated as required by applicable law. Continued use of the Sites after changes constitutes acceptance of the updated Policy.
